INDE : LA COUR SUPRÊME DE NEW DELHI ACCEPTE D'ENVISAGER LA REVISION DE LA LOI AFIN DE DEPENALISER L'HOMOSEXUALITE

Militants LGBT après la décision de la Cour Suprême de New Delhi, le 2 février 2016.

La Cour Suprême de l’Inde a accepté de transmettre à une chambre constitutionnelle spéciale la pétition présentée par l’ONG Naaz Foundation et d’autres groupes, qui demandent la révision de sa décision affirmant la validité de l’article 377 du code pénal indien qui pénalise l’homosexualité. Les trois juges saisis de la demande ont décidé de la renvoyer devant cette formation plus solennelle composée de cinq confrères, vu qu’elle soulève des questions de constitutionnalité importantes. Ils ont suivi en cela l’argumentation de Kapil Sibal, conseil des associations.

Celui-ci a affirmé que l’affaire touche au droit le plus intime et le plus précieux des personnes, le « droit sexuel », arguant que personne ne devrait s’y opposer tant qu’il est question de personnes consentantes et que cela reste dans la sphère du privé. Critiquant, à la suite d’une nouvelle pétition, la décision de la Cour Suprême du 12 décembre 2013 de maintenir la pénalisation de l’homosexualité et l’ordonnance similaire du 28 janvier 2014, Kapil Sibal a déclaré que cela portait atteinte aux droits des personnes homosexuelles qui ont été « stigmatisées » par le jugement initial « à deux juges ». C’est par lui que la Cour Suprême avait renversé la décision de la Haute Cour de New Delhi du 2 juillet 2009 dépénalisant les rapports sexuels consentis entre deux personnes du même sexe.
 
Pour les représentants de l’organisation Naaz Foundation, la décision de la Cour Suprême s’apparente à une « erreur de justice flagrante ». Soutenant que l’amendement 2013 du paragraphe 375 concernant le viol considère que les rapports consentis entre un homme et une femme ne constituent pas un délit, ils ont fait valoir que le paragraphe 377 pénalisant les rapports homosexuels constitue manifestement une discrimination envers les homosexuels masculins et les transgenres, contrevenant à l’article 14 de la Constitution de l’Inde.

Le renvoi de la pétition devant la formation constitutionnelle de la Cour Suprême constitue une première victoire pour la minorité LGBT dont l’avocat réclamait exactement cela. Les juges n’ont pas voulu suivre les arguments contraires de plusieurs organisations, religieuses notamment, et de quelques individus.
 
Du côté des ONG, on soutient que les décisions antérieures font preuve de « préjugés » à l’égard des personnes LGBT, puisqu’il y est question de leurs « prétendus droits » et qu’elles sont qualifiées de « fraction minuscule de la population du pays ».

A SIMPLE PROPOSAL : AUTOMATIC PENALTIES FOR DISOBEDIENCE MOVEMENT

Is it time for the United Methodist Church to do away with church trials to adopt a more efficient system of automatic penalties for wayward clergy?

As documented on this website and elsewhere, the United Methodist Church is being besieged by an apparently nationally orchestrated movement of a relatively tiny minority (far less than two percent of the whole) of radical United Methodist clergy performing pastorally harmful same-sex “sin blessing” ceremonies, in open defiance of the biblical church policies they vowed at their ordinations to uphold.

Liberal United Methodists from Amy DeLong to Adam Hamilton support various proposals to get our denomination, to one extent or another, to follow in other mainline denominations’ disastrous footsteps, while ultimately conceding that they will likely not have the votes at this next General Conference to liberalize church policies on marriage. And if they got their way in officially liberalizing our moral standards, this is guaranteed to split our denomination, as the record of other mainline denominations makes clear.

Other proposals would strengthen enforcement provisions for situations of clergy choosing to step outside of the covenant into which they chose to be ordained while largely leaving the basic structures of our denomination’s accountability system intact.

While it is no secret that I prefer the latter approach over the former, I ask if it is not time to take a major step further by radically replacing the UMC accountability system as we know it with a much more efficient system of automatic accountability.

Towards that end, I have submitted to the 2016 General Conference a relatively simple, two-part legislative proposal to establish automatic penalties for clergy who admit to performing same-sex unions. It does so by creating a separate accountability process for this single offense.

I carefully worded it to have zero impact on the rights of clergy who are involved in any other sort of wrongdoing, or who are falsely accused of anything. The reason it singles out the cases of clergy who are unambiguously guilty, by their own admission, of violating the prohibition against same-sex union ceremonies is because there is no other form of covenant-breaking that has been pushed by such a well-funded (but unrepresentative) disobedience movement, with the open goal of encouraging too overwhelming a number of violations for our tedious current accountability system to be able to handle.

We have seen numerous recent cases of folk ordained into United Methodist spiritual leadership demonstrating a remarkable lack of integrity by flippantly violating their vows to not perform same-sex union ceremonies, bizarrely bragging in the media about not being men or women of their word, and enjoying the protection of sympathetic bishops who arrange for largely consequence-free “just resolutions” (the church equivalents of out-of-court settlements).

Under the new automatic-penalty system, any clergyperson who openly admits to performing a same-sex union ceremony, which has long been prohibited in the Book of Discipline covenant they vowed to uphold, or who tries to play legalistic games by refusing to cooperate with the bishop’s basic attempts to determine the most relevant facts, would face swift, automatic, and major consequences.

If this is the first time the clergyperson has committed such an offense, s/he shall be suspended for at least one year, and potentially as many as three years, from key benefits of the covenant s/he has chosen to break (serving as a minister or in appointed leadership positions). At the end of their suspension, the wayward clergyperson shall be given a clear choice: either re-commit to the clergy covenant s/he chose to walk away from or else be defrocked from United Methodist clergy status.

Our denomination does not ordain anyone in the first place who will not first vow to God and the church to uphold our disciplinary covenant, among many other vows. This new system would not ask anything more of those who choose to leave this covenant and are seeking to be admitted back in.

This is no more unreasonable than asking an adulterous husband to recommit to his marriage vows of faithfulness before he can be fully reconciled with his wife.

Unlike several recent embarrassing cases, the result would be clear and readily understandable to all: the UMC rules do not clergy to perform allow same-sex union services, and so this United Methodist clergyperson was not allowed to continue performing same-sex union services.

The covenant-breaking clergyperson would no longer have any right to make their case in a church trial of their peers, would not have any possibility of dragging things out with further appeals, and would be categorically excluded from the Discipline’s frequently abused “just resolution” process.

The savings to the church’s time, finances, and emotional energies by having such efficient, just, and sensible accountability would be great. And we would ironically accomplish the stated goal of the homosexuality-affirming United Methodist activists who have recently rallied around the slogan, “stop the trials!”
After seeing the offending party so decisively removed from United Methodist ministry, other clergy currently promoting the disobedience movement would think twice before going down that same road.

This plan would offer by far the quickest, most decisive way for our denomination to move forward in mission beyond our present internal conflicts over sexuality.

Since this requires amending the section of the United Methodist Book of Discipline known as the Constitution, some have questioned if such a proposal could get the necessary two-thirds vote of General Conference and then two-thirds of the votes of every annual conference delegate around the world.

I readily admit that this would be a rather dramatic change and would be an uphill battle to pass. But the political odds may not be as steep as some have suggested.

Anyone who spends half a minute thinking about it understands that a large denomination like ours needs some sort of operating standards. No one seriously argues that clergy should be categorically free to violate these standards without any accountability (which would be the same as having no policies).

Rather strong super-majorities (well north of 60 percent) at recent General Conferences have repeatedly voted to maintain policies forbidding our clergy from performing same-sex unions. (For some reason, even significant numbers of delegates who vote to “soften the language” in our Social Principles calling homosexual practice inherently “incompatible with Christian teaching” also vote for the binding policies forbidding same-sex unions.) Furthermore, votes on other constitutional amendments in recent years suggest that annual conference voters are relatively more conservative than those at General Conference.

And unlike the U.S. Constitution, the UMC Constitution is routinely amended in several places at once.

But as an elected General Conference delegate myself, this plan has my vote.

The first petition, #60802 (printed on pages 1078 and 1221 of the Advanced Daily Christian Advocate) is the constitutional amendment, with underlines reflecting language this petition proposes for addition, while non-underlined text is what is already in the Discipline:
 
Automatic Penalties – I

Amend Book of Discipline ¶ 20 as follows:
¶ 20.  Article IV.—The General Conference shall not do away with the privileges of our clergy of right to trial by a committee and of an appeal; neither shall it do away with the privileges of our members of right to trial before the church, or by a committee, and of an appeal.14  This shall not apply to cases of clergy who admit to their bishop, or to the bishop supervising a directly relevant complaint against them, of having conducted a ceremony celebrating a homosexual union or performed a same-sex wedding ceremony.  In such cases, automatic penalties shall be imposed. 
 
Rationale:  Currently, a small minority of covenant-breaking clergy have been abusing our lengthy accountability system to use the threat of the costs of church trials to avoid serious accountability for this one offense.  This would allow for a more effective, efficient, and ultimately less painful process than trials. 
 
The second, implementing petition is #60803 (found on pages 1141 and 1223):
 
Automatic Penalties – II
 
Amend Book of Discipline ¶ 363.1 by adding after ¶ 363.1a a new section, ¶ 363.1b, and re-lettering the following sections accordingly:
  1. b) Automatic Penalty for Acknowledged Same-Sex Unions—other provisions of the Book of Discipline notwithstanding, when the complaint is based upon allegation of the specific misconduct of a clergyperson having conducted a ceremony celebrating a homosexual union or having performed a same-sex wedding ceremony (¶ 2702.1b) within the preceding six years, this separate process shall be followed:

(1) Upon receiving the formal complaint, the bishop or the bishop’s designee shall, within a timely manner, directly request the person against whom the complaint was made for a brief written statement simply confirming or denying if he or she did in fact conduct or perform the Disciplinarily prohibited ceremony in question.  In any meetings related to this process, both the person against whom the complaint and the person making the complaint may choose another person to accompany him or her with the right to voice.
(2) Throughout this process, the complaint shall be treated as an allegation or allegations until the person against whom the complaint was made delivers written confirmation of having conducted or performed the alleged prohibited ceremony or until 30 days have passed since he or she received the bishop’s request for confirmation or denial, and has chosen to give no answer.
(3) If the person against whom the complaint was made provides a written response to the bishop’s initial request other than confirming having committing the chargeable offense in question, then the ordinary supervisory response as outlined beginning in ¶363.1c below shall be followed as outlined below. 
(4)  If the clergyperson against whom the complaint was made either admits to have conducted or performed the Disciplinarily prohibited ceremony in question, or chooses not to deliver a response within 30 days of receiving the request for confirmation or denial of the offense, then he or she shall be considered guilty of having broken covenant with The United Methodist Church.
(5)  If the clergyperson’s file indicates that that he or she has previously been penalized according to this process, then the penalty the bishop imposes shall be termination of the conference membership and revocation of the credentials of conference membership, commissioning, ordination, or consecration of the clergyperson.  Otherwise, the bishop shall suspend the guilty party from all ministerial functions, and from any appointment to a local church, general agency, or cabinet-level position, without salary, for a period of no less than one year. 
(6)  The precise length of this suspension shall be at the bishop’s discretion, provided that it shall not be less than one full year and not more than three full years.  There shall be no right to appeal such a penalty.  A record of this penalty shall be placed in the clergyperson’s file. 
(7) 60 days before the conclusion of such a suspension, the bishop shall contact the suspended clergyperson, either directly or through a designee, to request a written statement promising to not conduct or perform any such ceremonies in the future as long as doing so remains a chargeable offense under our Church’s communal covenant as expressed in our Book of Discipline.  If the suspended clergyperson fails to make such a written promise, the bishop shall at the conclusion of the suspension period permanently terminate his or her clergy status. 
(8) All of the process as outlined above shall be carried out in a timely manner, with attention to communication to all parties in the process.  At the determination of the bishop, persons with qualifications and experience in assessment, intervention, or healing may be selected to assist in this process.  The bishop also may consult with the committee on pastor-parish relations for pastors, the district committee on superintendency for district superintendents, appropriate personnel committee or other persons who may be helpful. 
(9)  When this special process for the specific offense of conducting a ceremony celebrating a homosexual union or performing a same-sex wedding ceremony is initiated, the bishop shall notify the chairperson of the Board of Ordained Ministry that a complaint has been filed, of the clergyperson named, of the general nature of the complaint, of each response of the person against whom the complaint was made to the requests noted above, and with a summary the bishop’s own subsequent actions in implementing this process. 
 
Rationale:  This efficiently lessens our reliance on trials for covenant accountability. It prevents a single minister from holding an entire conference hostage with a needless, costly trial. There is only one chargeable offense for which there is such a disruptive minority movement to shatter the integrity of our connectional covenant.

    I am all for this. It would remove the grandstanding, but would still allow those who wanted to change the rules to try to do so legislatively. There is no excuse for breaking a covenant.

    While I support this type of legislation, I do not believe that its current form will withstand scrutiny by the Judicial Council. If you recall in the appeal of Frank Schaefer, the Judicial Council overturned his defrocking by ruling that his defrocking “cannot be squared with the well-established principle that our clergy can only be punished for what they have been convicted of doing in the past, not for what they may or may not do in the future.” Therefore, my suggestion is to remove the part of the legislation that requires clergy to recommit themselves to the clergy covenant or face being defrocked. Instead of blurring the line that the Judicial Council defined regarding future behavior, remove your new paragraph 7, and rely upon the punishment outlined in your new paragraph 5 if the behavior is ever repeated.

      If this passed, we would need to amend the Constitution, which this plan would do, and would COMPLETELY change the ball game from the Discipline with which the JC worked in the Schaefer case.

        One might want to consider a fixed punishment put in place for performing same-sex marriages, regardless if the clergy admitted their guilt or if found guilty at a clergy trial. Otherwise, if something like your plan was enacted, the next objective of those determined to get their point across might be to tie up the cabinet, clergy and conference administrations of various conferences with numerous trials – with the hope of getting a sympathetic jury or causing a greater schism from within.

    This probably concerns a different section of the Discipline, but in the case a bishop is being charged, who would be the supervising bishop? And if its the president of the Jurisdictional Conference Council of Bishops, what happens if that is the person being charged?

    You write of covenant-breaking clergy who flippantly violate their vows. There was nothing “flippant” in my decision treat a same-sex couple the same way I would treat a heterosexual couple. Here is my justification for officiating at a same-sex marriage.

  • Keeping Covenant with the Church

  • In officiating at the wedding of DeLyn and Sarah Celec, and as a regional organizer for “An Altar for All,” I have sought to keep covenant with the Church. I have acted in good faith and in good conscience. First and foremost I have sought to be true to my baptismal vows. The second vow asks “Do you accept the freedom and power God gives you to resist evil, injustice and oppression in whatever forms they present themselves?” Ordinarily I work within the church to address evil, injustice and oppression in the world. Sadly, in this case, injustice and oppression exist within the church, i.e. in its language about homosexual practice and its policies regarding ministry and marriage. The language of that second baptismal vow does not exempt the church—it says “in whatever forms they present themselves.” So, in good faith and in good conscience I am trying to keep that vow by addressing injustice and oppression within the church.

  • When I took vows to “support and maintain” our “Church government and polity” that was because I had previously answered affirmatively that I believed our “doctrines are in harmony with the Holy Scriptures.” In regard to homosexuality and same sex marriage, I no longer believe our doctrines are in harmony with Holy Scripture. Specifically, I believe we have used scriptural texts that do not address the context of sexual orientation and committed relationships we see today to exclude LGBTQ persons from ministry and marriage. More importantly, Jesus commanded us to “Do unto others as you would have them do unto you.” When Marsha and I committed to love each other until “death do us part,” we had the blessing of church and state. I want that same blessing for LGBTQ persons. I believe I am acting in Biblical obedience when I bless and consecrate the committed loving relationships of all prepared couples without regard to gender or sexual orientation.

  • I believe I am acting in ecclesial obedience to a Church that believes all people are created in the image of God and that “homosexual persons no less than heterosexual persons are individuals of sacred worth.” In the Discipline we read: “Inclusiveness means openness, acceptance, and support that enables all persons to participate in the life of the Church, the community, and the world. Thus, inclusiveness denies every semblance of discrimination. The mark of an inclusive society is one in which all persons are open, welcoming, fully accepting, and supporting of all other persons, enabling them to participate fully in the life of the church, the community, and the world.” Paragraph 140 In excluding many LGBTQ persons from ministry, the Church has deprived itself of their gifts and graces and made its claims to inclusiveness a sham. We read, “Without creative use of the diverse gifts of the entire Body of Christ, the ministry of the church is less effective.” Paragraph 303.4 The book of Discipline makes a powerful statement for inclusion. As Bishop Melvin Talbert notes, “It only contradicts itself in a few places.”

  • I love the United Methodist Church—it has nurtured and challenged me. If I am “out of order,” it is because of our heritage of opposing injustice and oppression. It has shaped my conscience and called me to act. I am honored to be among the ordained clergy of the United Methodist Church and I want to keep my credentials and ordination, but not at the price of complicity in discriminatory policies. At the same time, a church trial and losing my credentials would be a small price to pay (for me as retired clergy) if it exposes the moral bankruptcy of our policies and helps move us to change them.

      Let me get this straight…. You are a retired elder in the UMC and you are a Professor Emeritus at a University affiliated with the UMC. You have previously violated your clergy covenant and the BoD; yet, you claim that you love the UMC and that you are honored to be among its ordained clergy. I respect a person’s right to change their religious beliefs; however, if that happens then that person needs to quit being a representative of a denomination that no longer reflects his/her beliefs. You all but say that the UMC is hypocritical regarding its treatment of LGBTQ individuals; yet, I see you as the hypocrite – by not surrendering your credentials, you choose to remain as a representative of a denomination with which you do not truly represent. Of course, this is just my opinion — it is obvious that you will rationalize your choices however you choose.

        Our church has a wonderful statement on inclusiveness–I represent that. Those who discriminate against same-sex couples should surrender their credentials for violating the BoD. This seems pretty clear: “Thus, inclusiveness denies every semblance of discrimination. The mark of an inclusive society is one in which all persons are open, welcoming, fully accepting, and supporting of all other persons, enabling them to participate fully in the life of the church, the community, and the world.”

          It is not a matter of accepting or welcoming a person who may be attracted to a person of the same sex. The issue is one of sexual behavior between two people of the same sex. Sexual behavior, whether heterosexual or homosexual, signifies a choice to act. The reason why same sex marriages should not be performed by our clergy is because with marriage comes the long-standing expectation of the involvement and the inclusion of sexual relations with the spouses. Therefore, to endorse same sex marriage is the same as endorsing homosexual behavior. Granted, some will argue that just because a couple is married does not mean that they have sex; however, traditionally the majority of people equate the two, especially given that Christian beliefs do not express an approval of sexual relations except within the bonds of marriage. Therefore, your argument is flawed. The statement on inclusiveness states that we are to be “open, welcoming, fully accepting, and supporting of all other persons…”. The term “persons” is the key. Persons is synonymous with “individuals” or “people” and does not imply in any way an acceptance of a behavior between two people that traditional Christian beliefs and scriptural precedent deem immoral.

      I agree with elimbo: If you have had a revelation that is no longer compatible with UMC beliefs, then leave! I do not criticize nor condemn your beliefs but they no longer fall in line with the church’s stated beliefs which I have absolutely no problem with! The question re whether or not same-gender relationships are also ordained by God is not what is damaging the church; we should always be questioning our beliefs and understandings. The problem is people like you who believe same-gender relationships are ordained by God and are trying to force their new found “enlightenment” on everybody else! I can only respect your right to your belief only if you respect my right to mine; if that is not possible then we and by extension, the UMC has a huge problem.

The mark of an inclusive society is one in which all persons are open, welcoming, fully accepting, and supporting of all other persons, enabling them to participate fully in the life of the church, the community, and the world.” I’m fully compatible with it–too bad the BoD contradicts itself.

          Since when is it discrimination to disapprove of a person’s behavior that scripture and Christian tradition also disapproves? The UMC can be welcoming and accepting of individuals without approving of immoral behavior.

            I faithfully served a three month suspension for the “offense” of offering pastoral services to a same-sex couple, and afterwards was elected as a delegate (even if next to last) to Gen/Juris Conf. Why would I want to withdraw if colleagues support me?

            I have a feeling that you really know what you are doing is very evil. You can fool yourself, but no one can fool God. Jesus said “I assure you: Anyone who doesn’t enter the sheep pen by the door but climbs in some other way, is a thief and a robber.” When you have a broken relationship with God, you need to pray to God to help mend it and be open to God’s leading.

            Reading your post makes me wonder whether you read my initial response with the justification for my action titled “Keeping Covenant with the Church.” No, I do NOT think what I am doing is evil and my relationship with God is lively and intimate. Right now I am with a dozen United Methodist clergy friends in a week long pre-Lenten retreat. For five days we read, study, pray and worship together, beginning at 5:30 a,m each day. My opposition to the derogatory statement and discriminatory policies in the BoD is rooted in my baptismal vow “to resist evil, injustice, and oppression in whatever forms they present themselves.” I don’t doubt the sincerity of your faith.             Yes, I read your “Keeping Covenant” statement. You call God’s way on morality injustice and oppression and what God says is evil, you say is good. I think you need to be honest with yourself about evil. I once talked to an Episcopal bishop who allowed this. I ask him if it was evil and he greatly surprised me by saying “It’s very evil.” Then I ask him how he could reconcile his position with the bible. He said “I can’t – I’m still working on it.” At least he admitted it was evil. Every tree that does not bear good fruit will be cut down and fed to the fire. Think about morality: are you with God or against God?

I don’t know why the Episcopal bishop said what he was doing was evil–I believe I am doing God’s will by consecrating the love of committed, loving couples regardless of sexual orientation. And, I have studied the Biblical and theological arguments on both sides, have you? If so, you would know there are compelling reasons to believe that the Biblical texts, including Romans 1, are addressing a cultural practice the authors associated with temple prostitution and idolatry, not the committed loving relationships that our homosexual brothers and sisters are asking us to bless today. I disagree with it; but I do recognize that with regard to the decisions you have made, you have made them because you see them as an attempt to keep your vows. And I appreciate that. You articulate yourself much better than most arguments that I have seen as justification for the decisions and actions they have taken, many of which seem to me to be about keeping one’s vows as much as simply treating them like they were part of a Burger King commercial — “Have it your way.” Thanks for sharing something of a more thoughtful nature.

    I’m in complete agreement with the present wording of the BoD. I believe it is an insult to all who take their ordination vows seriously (including many who want to see the BoD changed to allow for the more full inclusion of homosexuals in the life and ministry of the UMC, but are unwilling to violate their vows) for some who have violated those vows to receive what amounts to little more than an administrative slap on the wrist as a consequence. But I cannot support this suggestion. It is just as unloving as those who would harm the church by acting against its Discipline, for it creates a new Discipline that has little to no room for grace in it. That doesn’t strike me as very Christian, let alone Methodist.

    A UM church in Nashville (pastored by a Woodstock relic) took great pride in renting out its space to the local gay church on Sunday evenings, and the UM pastor (a serial adulterer, btw) himself presided over several “holy unions” (apparently because the gay couples felt it was more legit to be blessed by a mainline pastor than by the gay pastor of the gay church).
    Frankly, I don’t comprehend the person who claims to be Christian and says “I have gay friends and relatives, therefore it behooves me to break with 2000 years of Christian ethical teaching and perform gay marriages.” One of C. S. Lewis’s closest friends was Arthur Greeves, a homosexual. Lewis’s long friendship with Greeves proves that you can be bosom friends with a homosexual and never budge one millimeter from the biblical position on homosexuality. I figure there must be some emotional blackmail going on – “If you were really my friend, you would perform the wedding for me and my partner.” Well, the right response to that is, “If you were really MY friend, you’d respect my Christian beliefs, which prohibit me from doing what you ask.”

      I am an elder in the TN conference and I am currently appointed to a church just outside Nashville. I haven’t heard anything about the situation which you mentioned. Could you elaborate some more about it? Has a complaint ever been filed against the pastor?

        This was back in the 1980s, and that pastor has been retired for 20 yrs. I’m not trying to get anyone in trouble, just relating an anecdote from the past – “nothing new under the sun,” as it says in Ecclesiastes. I imagine that pastor has been overjoyed at last year’s SCOTUS decision, and at how most of the mainline denominations now ordain homosexuals, but I’m sure he’s anxious that the UMs follow suit before he goes to meet his Maker (which will be a highly educational experience).

      Go for it! I used to work for the UM Publishing House, I caught on to them years ago. If someone ran the numbers,they’d probably find that ex-UMs now outnumber the UMs by a wide margin.

    A big divide in the churches:
    One group turns to God for salvation and a new life.
    The other group turns to God for approval of their present life.
    The churches might look the same on the outside, but they are radically different in their beliefs. Clergy who belong to the second group are trying to set themselves up as being more generous than God, and trying to be better than God is a dangerous thing to do.

    Since the Anglican worldwide communion just disciplined the American Episcopal Church (AEC), and it appears the AEC will be out of the communion altogether after their three year time-out period since the AEC has no intention of coming back to orthodox practices — why don’t we, the UMC, reunite with the Anglican world communion? Our liberal clergy, lay, and academies can merge with the AEC. The orthodox in the UMC, including those in the global south, with the worldwide order?
    Didn’t Wesley reluctantly ordain a bishop named Thomas Coke after the Revolutionary War which created the American Methodist Episcopal Church? Since that particular war is in the past, and a new revolution/war (spiritual & western cultural imperialism) has begun, perhaps it’s time to reunite with our brothers and sisters in the Anglican worldwide communion?
    I’m sure there are good reasons why we should not do this, but I just don’t see them.

En cas de soupçons de pédophilie au sein de l'Eglise catholique, les évêques n'ont "pas nécessairement" l'obligation d'en faire part aux autorités : ils peuvent simplement les gérer en interne. C'est l'indication donnée aux nouvelles recrues, d'après un document récemment publié par le Vatican, raconte le Guardian (en anglais) dans un article repéré par Slate.fr.

"Il n'incombe pas forcément à un évêque de signaler les suspects aux autorités, à la police ou à un procureur s'ils sont informés d'un crime ou d'un acte immoral", peut-on lire dans ce texte, rédigé par le prêtre français Tony Anatrella, consultant pour le Conseil pontifical pour la famille, controversé pour ses positions sur la supposée "théorie du genre".

"Tolérance zéro", réclamait le pape

Ces directives font partie d'un programme de formation à destination des évêques nouvellement ordonnés. Elles contrastent avec la position affichée par l'Eglise catholique ces dernières années après de nombreux scandales : le pape François a ainsi appelé à une "tolérance zéro" face aux actes pédophiles et a affirmé que "tout doit être fait pour débarrasser l'Eglise du fléau des abus sexuels", rappelle le Guardian.

Une commission spéciale a d'ailleurs été créée : il s'agit de la commission pontificale pour la protection des mineurs, note le quotidien britannique. Cette dernière n'a apparemment joué aucun rôle dans ce programme de formation, alors qu'elle est justement supposée développer des "bonnes pratiques" pour gérer ce genre de cas. Selon un responsable de l'Eglise, cité anonymement, la position de la commission en la matière est claire : signaler les cas de pédophilie est "une obligation morale, que la loi le requière ou non".

« Nous avons tous la responsabilité morale et éthique de notifier tout cas présumé d’abus aux autorités civiles chargées de protéger notre société », rappelle le cardinal Sean O’Malley, président de la Commission pontificale pour la protection des mineurs dans une déclaration publiée par le Vatican.

Le cardinal Seán O’Malley, OFM Cap., président de la Commission pontificale pour la protection des mineurs, avec tous les membres de la Commission, a publié ce lundi 15 février, la déclaration suivante sur l’obligation de notifier aux autorités civiles tout cas d’abus sexuel présumé :

« Comme l’a si clairement déclaré le pape François, « les crimes et les péchés des abus sexuels sur des mineurs ne doivent plus être maintenus plus longtemps sous secret. Je m’engage à la vigilance zélée de l’Eglise pour protéger les mineurs et je promets que tous les responsables rendront compte » (27 septembre 2015). Nous, le président et les membres de la Commission, tenons à affirmer que nos obligations relevant du droit civil doivent certainement être respectées, mais même au-delà de ces exigences civiles, nous avons tous la responsabilité morale et éthique de notifier tout cas présumé d’abus aux autorités civiles chargées de protéger notre société ».

La déclaration du cardinal O’Malley se poursuit ainsi : « Aux États-Unis, notre Charte des Évêques affirme clairement l’obligation pour tous les diocèses et éparchies, ainsi que pour leur personnel, de notifier les cas suspects d’abus aux autorités publiques. Tous les ans, à notre rencontre de novembre, lors d’une session de formation pour les nouveaux évêques, cette obligation est réaffirmée et chaque année, en février, la Conférence organise un second programme de formation pour les nouveaux évêques, qui inclut aussi clairement et explicitement cette obligation.

« En tant que Commission consultative du Saint-Père pour la protection des mineurs, nous avons récemment partagé avec le pape François une synthèse des efforts importants faits en matière d’éducation dans les Églises locales ces deux dernières années, et nous avons réaffirmé la volonté des Membres de fournir ce matériel à travers des cours proposés à Rome, y compris pour le programme annuel de formation des nouveaux évêques et pour les bureaux de la Curie romaine, afin qu’ils puissent l’utiliser dans leurs propres efforts de protection des enfants. »

For reasons that defy all logic, leftists continually apologize for the acts of Muslims, despite how sickening and twisted their traditions are. Any person with a hint of morality are taken aback at the pedophilic  practices that many “modern” Muslims engage in, as child brides are just one of the traditions that Mohammad set into practice 1,400 years ago.
 
But when the United Nations’ “children’s rights” organization known as UNICEF (Children’s Rights and Emergency Relief Organization) was asked what should be done about children being systematically raped by their much older Muslim husbands, this deplorable organization weighed in….with their startling opinion.

As a mass horde of refugees make their way to Europe, one of the controversial topics of child marriage is now having to be addressed. The small European nation of Norway has already opened their doors to over 60 of these child brides along with their adult husbands. But instead of this “children’s rights” organization stepping in and being a voice for these abused girls, these liberal asshats have a sickening viewpoint on the situation.



UNICEF took a stance in defense of Muslims saying that instead of breaking up these marriages, that they believe that laws should be violated, and in so doing they condone these young girls being raped by their adult “husbands.”


Merete Agerbak Jensen wants to break federal law to ensure that young girls can remain with their pedophile husbands.

“In some cases it may be best for the child to remain in a marriage after they have come to this country. In circumstances where those who are married are not too young, in a totally voluntary and fairly equal relationship and maybe has a child, it may in some cases be in the child’s best interest that we do not strictly follow the law,”UNICEF Norway’s Merete Agerbak Jensen responded.


Doubling down on the insanity, liberal Norwegian Professor Per Fugelli echoed Jensen’s sentiments, saying that these pedophilic practices should be accepted and respected since it is these Muslims’ “culture and belief.”

The professor went on to say that Westerners should accept the abuse, and allow the marriage, reiterating that the West should respect these refugees because they’ve recently “been through war.”

How absolutely disgusting! Instead of stepping in and rescuing these poor victims who will continue to be raped at the hands of their older depraved husbands, these liberals will continue to make excuses for this sick practice, and demand that the west accept it since it’s “part of Muslim culture.” How long before the leftists here in America begin fighting hardcore for the rights of pedophiles, as the influx of Muslim refugees continue to make their way to our country?

Christians, women and gay men are among the groups of asylum seekers needing their own accommodation in Germany after facing attacks by fellow migrants.



In Stuttgart, 30 Christians have been moved into their own digs after frequent attacks by other migrant-seeking Muslim men.

Elsewhere gay men are being persecuted, and women, some who have been sexually abused by ISIS militants, have been moved to secret locations.


The group of Middle Eastern Christians in Stuttgart were moved into new homing after they had their bibles torn up and crucifixes smashed by fellow migrants.

The city council finally acted after a campaign group complained about the abuse and a petition signed by 17,000 people demanded they be better protected.


It said: 'We call on the city to make it possible for them to have a communal place for Christians and protect them from further threats and attacks which they are suffering in the central gathering place for asylum seekers.'

The move was a significant one because until now Germany had been trying not to separate refugees on ethnic or religious lines.

The local evangelical church spokesman Stefan Walter said: 'The Christian refugees come from lands where Christians are under threat.

'Putting them all together is to ignore the right they have to protection, and is an insult to the victims of Islamic oppression.'

However, the violence shows no sign of dying down any stage soon.

Martin Lessenthin, the CEO of the International Society for Human Rights, said he knew of many similar conflicts in accommodations in Barton Wurttemberg, but also in Berlin and Nuremberg.

He claimed the abuse was mostly directed at Yazidis and Christians, adding the answer was to make everybody accept German law.

'Ethnic or religious separation is not the answer, anyone who arrives here needs to follow German law in its entirety.'

The German government has also provided support accommodation at secret locations for female victims of ISIS.

Winfried Kretschmann, Baden Wurttemberg's Minister-President, has a special program to help a total of 1,100 female victims of ISIS.

Klaus-Peter Murawski, the program's co-ordinator, said the victims of sexual assault included one girl as young as eight.


The women, many of whom were Yazidis or Christians from northern Iraq and Syria, were sexually abused and beaten, and many of them were kept as slaves after being taken from their families.

In Lower Saxony, the region was the first to agree to take 70 women from a special allocation of refugees who cannot be placed in with other refugees.

And it also funded special psychological care and medical assistance for the women as a result of what they had experienced.

As well as non-Muslims and women, LGBT refugees are also now needing their own accommodation.

Jorg Steinert, managing director of the Lesbian and Gay Association in Berlin-Brandenburg, reported that since last year the number of attacks has skyrocketed.
He said: 'In particular, small, petite, feminine gay men are often beaten or sexually assaulted.'

He said that as a result in Berlin and Nuremberg there are already separate places where they could be accommodated being made available and the first residents would be able to move in shortly.

There are also growing numbers of reports citing violence between the mostly Muslim groups that remain, with frequent police callouts to tackle the violence.
Recent incidents this week have seen pitched battles involving nail-studded planks and knives being used.

  You would have thought that if there was any one event that could turn Europeans against the notion that the EU is capable of accommodating the millions of asylum seekers fleeing the war-torn Mid-East it would be a terrorist attack on a major European capital.

As it turns out, sentiment towards refugees was remarkably resilient in the wake of the Paris attacks. Sure, France closed its borders, but by and large, it appeared that Europeans viewed the attacks as a reminder of why people were fleeing Syria and Iraq rather than as emblematic of what they would ultimately export to Western Europe.

But sentiment did eventually sour. Not due to a terrorist attack, but rather due to a wave of sexual assaults on New Year’s Eve.

Women gathered in the city center in Cologne, Germany reported being groped and robbed by “gangs” of Arabs, and once reports of the attacks made international headlines, victims came out of the woodwork as allegations poured in from Austria to Finland, to Sweden where several prominent newspapers alleged a vast coverup of incidents that allegedly took place at a youth festival in central Stockholm’s Kungsträdgården last August.

The revelations have sparked a massive backlash against refugees and have also served to whip certain segments of the population into a nationalistic furor that now threatens to upend the political establishment in a number of European countries.

"We have seen what they are capable of. They are testosterone bombs,” far-right Dutch politician Geert Wilders said last month. "It's sexual terrorism, a sexual jihad,” he added.

Make no mistake, we certainly understand Europe's frustration with what, if the allegations are true, are a series of deplorable attacks and with the ineptitude officials have shown when it comes to tackling the bloc's refugee crisis.

But we can't help but wonder whether it occurred to wSieci that Syria and Iraq (where the refugees are coming from) have been getting "raped" by the West and its regional allies for more than a decade. Metaphorically speaking of course.

«Je suis en état d’urgence sexuelle » ! C’est, en substance, l’affirmation d’un migrant à Vienne en Autriche pour justifier le viol d’un enfant de 10 ans. Une défense, pour le moins, atypique… que la police n’a pas voulu médiatiser. On peut les comprendre, l’histoire fait mauvaise presse à la volonté dominante d’accueillir « les pauvres réfugiés fuyant la guerre et l’oppression » ! Le chef du bureau de la police d’État de Vienne a commenté : « Si on nous le demande, nous confirmons les faits, mais ne communiquons pas de manière pro-active sur le sujet ». Par là, il faut comprendre que la police autrichienne ne souhaite pas être taxée de faire le « jeu de l’extrême droite », ou des contestations antimigrants qui fleurissent partout en Europe. C’est vous dire à quel degré de bêtise on est arrivé !

Le mensonge par omission est devenu la norme dans cette Europe qui couve une des plus grandes crises de son Histoire : une partie de son peuple est en passe de se rebeller et les migrants se font une place en bousculant tout sur leur passage, sous le regard bienveillant d’une grande majorité des intellectuels, des médias et des politiciens européens.

L’urgence sexuelle, donc, est le nouveau moyen de défense des migrants ! Gageons qu’avec nos systèmes judiciaires portant aux nues les Droits de l’Homme, il pourra profiter de tous les recours jusqu’à la Cour Européenne qui, elle-même, pourra se prononcer sur l’état d’urgence de la sexualité des migrants.

Par extension, tous les migrants qui ont participé aux « festivités » de la Saint Sylvestre en Allemagne et en ce moment à Cologne pour le Carnaval (22 plaintes pour agressions et viols le premier jour), seraient, eux aussi, dans des états d’urgence sexuelle. Une bonne justification qui plaira sans nul doute aux plus hautes sphères de notre intelligentsia, qui appellera les bons Européens à la tempérance et la compréhension et qui tapera sur les doigts du migrant qui doit s’adapter à notre société (d’ailleurs s’il n’arrive pas à s’adapter, c’est surement votre faute, lecteur !).

L’homme, en l’occurrence, a affirmé qu’il « ne pouvait pas supporter de ne pas avoir de rapports sexuels » après quatre mois d’abstinence. Il a donc fait avec ce qui lui tombait sous la main : et c’est tombé sur un enfant de 10 ans… magnifique humanité de ceux qui sont protégés par les humanitaires !

Le jeune enfant a évidemment été gravement blessé tant psychologiquement que physiquement par ce monstre. Il en gardera des séquelles jusqu’à la fin de ses jours… L’horreur du crime ne fera pas, malheureusement, pencher la balance ! J’ai peur que nos enfants et nos femmes aient encore à subir bien des maux avant la fin de cette histoire. Et dire que l’on nous incite à être tolérants et ouverts d’esprit…

ATLANTA, Ga. — The Georgia House of Representatives unanimously approved a bill this week that protects clergy from punishment if they decline to perform same-sex “weddings.”

H.B. 757 was introduced last summer by Rep. Kevin Tanner, R-Dawsonville, and found support from Democrats and Republicans alike.

“No minister of the gospel or cleric or religious practitioner ordained or authorized to solemnize marriages, perform rites, or administer sacraments according to the usages of the denomination, when acting in his or her official religious capacity, shall be required to solemnize any marriage, perform any rite or administer any sacrament in violation of his or her right to free exercise of religion under the Constitution of this state or the United States,” the bill reads in part.

In addition to churches, the bill also applies to religious schools, missionary societies and denominational conventions.

Mansour Bin Askar, professeur à l’université du Roi Saoud à Riyad, a déclaré dans une interview que le mariage précoce a toujours été encouragé en Arabie Saoudite. «Pendant les guerres, le mariage précoce a permis de renforcer les clans familiaux, ainsi que l’influence des tribus», a-t-il expliqué, en ajoutant : « Le mariage précoce, d’un point de vue médical, ne peut nuire à la jeune mariée. Toutefois, il est important d’avoir son consentement et confirmer sa décision devant un juge de la charia.»

Cet illustre professeur d’université a omis d’expliquer l’aptitude mentale d’une petite fille de 10 ans à prendre une telle décision et les conséquences de ce mariage sur son psychique. Au Yémen, au début des années 2000, une petite fille a été mariée avant d’atteindre la puberté. Elle est morte, victime d’une hémorragie sévère. La fatwa de ce mufti reflète, en fait, les réalités de la vie au royaume. Les filles sont mariées très jeunes, avec des prétendants, en majorité des vieillards, choisis par leurs pères et tout refus est puni par la flagellation. Toujours à contre-courant des autres pays musulmans, l’Arabie Saoudite a conservé l’interprétation intégrale de la charia.

Selon Leonid Isaev, spécialiste du monde arabe, la charia prévoit le mariage précoce mais avec certaines nuances. «Tant que la fille n’a pas atteint l’âge de la puberté, il lui est interdit d’avoir des relations sexuelles», a-t-il souligné. Ce phénomène est fortement critiqué, suscitant de nombreux débats en Arabie Saoudite pour interdire la loi sur le mariage des petites filles, ce qui a déplu au cheikh Abdul Aziz al-Teraifi, un fonctionnaire du ministère des Affaires islamiques, l’un des adversaires les plus ardents de ces restrictions. «L’interdiction du mariage précoce aura un effet négatif sur la société saoudienne, ce qui est inacceptable dans un pays musulman», a-t-il déclaré au journal Saudi Gazette.

En juin 2011, un théologien saoudien, cheikh Saleh al-Fawzan, allé encore plus loin. Il a émis une fatwa où toute obstruction au mariage précoce des filles est considérée comme une violation des lois d’Allah. Selon le cheikh, les pères ont le droit de donner leurs filles en mariage même si elles sont encore au berceau.

The youth wing of the Swedish Liberal party has filed a motion to legalize necrophilia and incest.

Liberal Youth of Sweden said that just because it is 'viewed as unusual and disgusting', does not mean that the deprived sexual acts should be illegal.

They want to legalize sex between two consenting siblings over the age of 15, and sex with a corpse if there is a written permission made before the person died.

 'We don't like morality laws in general, and this legislation is not protecting anyone right now,'  Cecilia Johnsson, Liberal Youth chairperson in Stockholm told Aftonbladet.

'We are a youth wing and one of our tasks is to think one step further.

'I understand that it [necrophilia and incest] can be seen as unusual and disgusting by legislation can not be based on it being disgusting.' 

The youth wing of the Liberals in Sweden voted to support legalisation incest and necrophilia at their annual meeting last weekend.

The suggested motion stated that two siblings, over the age of 15, who both consent, should be allowed to have sex.

It also said that if a person has stated in a written will that they consent to someone having sex with their corpse, this should also be legal.

'It should be your own decision what happens with your body after you die, and if that happens to be that you want to bequeath your remains to a museum or to science, or if you want to bequeath your remains to someone to sleep with them, then that should be ok,' Ms Johnsson adds.

Surely, you must understand that people are lauging at your liberalism, you nitwits? What other challenges facing society is on the top 100-list for Stockholm's Liberal Youth? Sex with hippos?

The controversial announcement was quickly criticised by the Liberals, and several senior figures within the mother party.

Former Liberal MP Carl B Hamilton lashed out at the youth wing, calling them 'nitwits', accusing them of craving publicity over politics.

'Liberal Youth of Sweden focuses on publicity, but hardly the issues that determines our, and Sweden's future,' he wrote on a Facebook group for Liberal party members.

'Surely, you must understand that people are lauging at your liberalism, you nitwits?

'And what other challenges facing society is on the top 100-list for Stockholm's Liberal Youth? Sex with hippos?'

A press spokesperson for the Liberals said on Monday the mother party does not back the youth wing, and wants both necrophilia and incest to remain illegal.

WASHINGTON (NNS) -- Secretary of the Navy (SECNAV) Ray Mabus issued an updated Department of the Navy Diversity and Inclusion Policy statement, Feb. 25, and met with several key military service organizations, veterans service organizations, and stakeholders at the Pentagon to discuss the topic.

The meeting was the first in a planned series of engagements during which Mabus will discuss Navy and Marine Corps issues with leaders in the civilian and military communities.

Mabus also released a short video underscoring the Navy and Marine Corps are stronger, more effective, and innovative when our workforce reflects the nation we serve.

"To recruit the people we need, to keep the people we need, we've got to draw from the biggest pool we can," Mabus said in the video released today. "The United States Navy and United States Marine Corps are the most formidable expeditionary fighting force the world has ever known. To keep that, we've got to reach out to the most diverse population we can to recruit and retain these top people."

The Department of the Navy last updated its Diversity and Inclusion Policy statement in 2010, and since then, the Department of Defense has made significant personnel policy changes including the repeal of "Don't Ask, Don't Tell," and rescinding the direct ground combat exclusion policy, which now allows women to serve in military occupational specialties that were previously closed to them.

"Our nation always faces new challenges and threats in an increasingly complex world," said Mabus as part of the updated statement. "Recruiting, retaining, and promoting top performers is a readiness imperative. Organizations that embrace myriad backgrounds and perspectives will attract the best talent and remain ready."

Mabus said the importance of having a workforce comprised of those who think differently, and have varied backgrounds cannot be overstated.

"We don't want everyone coming into the Navy or Marine Corps thinking exactly the same way," he said. "It's important that when such a small number of Americans are serving in uniform, that the force be representative of the people they're protecting. A more diverse force is a stronger force and we've proven that over and over and over again."

A Virginia-based group is committing consumer fraud by offering services it claims can convert people from gay to straight – deceptive practices that the Federal Trade Commission (FTC) must stop, according to a federal complaint the Southern Poverty Law Center and other civil rights groups filed with the FTC today.

The complaint describes how People Can Change (PCC) has offered these services known as “conversion therapy” despite the lack of scientific evidence to support their claims. It urges the FTC to investigate the group under Section 5 of the Federal Trade Commission Act, which prohibits unfair and deceptive acts and practices.

Conversion therapy is a harmful scam based on junk science – end of story,” said Scott McCoy, SPLC senior staff attorney. “Groups such as People Can Change are nothing more than modern-day snake oil salesmen. They prey upon vulnerable people with bogus claims that they can change someone’s sexual orientation.”

Conversion therapy has been discredited by virtually every major American medical, psychiatric, psychological and professional counseling organization. Many who have undergone such therapy have reported increased anxiety, depression, and in some cases, suicidal ideation.

Last year in a landmark SPLC trial, a jury unanimously found New Jersey conversion therapy provider JONAH had violated the state’s consumer fraud law. Despite a jury finding that JONAH had “engaged in unconscionable commercial practices” – including referring clients to PCC for services – PCC continues to operate in largely the same manner as before the JONAH trial, according to the complaint.

During the trial, JONAH clients described how they endured disappointment, frustration, and depression as conversion therapy services failed. JONAH’s so-called treatment strained family relationships for some men, leading them to blame family members for their sexual orientation.

“I wouldn’t wish it on my enemy,” plaintiff Benjamin Unger testified at the June trial. “It was very harmful. It made me very depressed, and people have a right to know about it.”

Four states and the District of Columbia have passed laws banning conversion therapy for minors. The governor of New York has used executive action to adopt regulations to protect young people from conversion therapy. U.S. Rep. Ted Lieu, D-Calif., has introduced federal legislation aimed at eliminating the practice.
The SPLC filed the complaint with the Human Rights Campaign and the National Center for Lesbian Rights. Law firm Cooley LLP served as counsel to the groups for the filing.

    Les membres de la Jeunesse libérale (LUF), liés au parti libéral suédois, ont proposé une réforme législative permettant aux gens d’être plus libres dans leurs pratiques sexuelles. Leurs ainés politiques n'ont pas approuvé ces idées controversées.

    Ces initiatives ont été annoncées et votées lors d'une réunion des jeunes libéraux le 21 février, informe le journal britannique The Independant. Selon la présidente de la LUF, Cecilia Johnsson, le mouvement dénonce des «lois moralisatrices» qui ne protègent personne.

    Tandis que le bureau central du parti a dénoncé ces propositions, les membres d'autres mouvements politiques de la Suède ont soupçonné qu'il s'agissait là seulement d'un coup de pub de la part des jeunes libéraux.

    Le bureau central du parti et sa jeune émanation sont déjà tombés en déssacord en 2005, suite aux propositions du chef du parti Jan Björklund, à l'époque ministre de l'Education. Il avait demandé aux enseignants de signaler les étudiants ayant des opinions extrémistes.

    Le parti suédois Les Libéraux, fondé en 1938, est actuellement le septième parti du parlement de Suède par le nombre de sièges, ses membres se prononçant pour l'adhésion du pays à l'OTAN et à la zone euro.

    Hundreds of children in western Pennsylvania were sexually assaulted by about 50 Roman Catholic priests over four decades while bishops covered up their actions, according to a state grand jury report released on Tuesday.

    The report found that former Altoona-Johnstown Diocese Bishop James Hogan, who died in 2005, and his successor, Joseph Adamec, who retired in 2011, worked to cover pedophile priests’ tracks and that some local law enforcement agencies also avoided investigating abuse allegations, said state Attorney General Kathleen Kane.

    “The heinous crimes these children endured are absolutely unconscionable,” Kane told reporters in unveiling the report, based on a two-year investigation. “These predators desecrated a sacred trust and preyed upon their victims in the very places where they should have felt most safe.”

    Revelations that some priests had habitually sexually abused children and that bishops had systematically covered up those crimes burst onto the world stage in 2002 when the Boston Globe reported widespread abuse in the Boston Archdiocese.

    That report, which won a Pulitzer Prize and was the subject of last year’s Academy Award-winning film “Spotlight,” set off a global wave of investigations that found similar patterns at dioceses around the world. They led to hefty lawsuits and seriously undermined the church’s moral authority.

    No criminal charges will be filed because the alleged incidents are too old to be prosecuted, Kane said.

    Advocates for victims of sex assault have long urged lawmakers to give prosecutors more time to bring charges of sex assaults of minors, noting that particularly in the case of assaults by members of the clergy, victims can take years to come forward.

    The report contains explicit details of scores of attacks, naming perpetrators, many of whom have since died. Many of the surviving priests were still serving parishes at the time the investigation began, Kane said, but all have since been removed by the current bishop.

    “This is a painful and difficult time,” current Altoona-Johnstown Bishop Mark Bartchak said in a statement. “I deeply regret any harm that has come to children.

    “We’re saddened but not the least bit surprised,” said David Clohessy, director of the Survivors Network of those Abused by Priests. “It proves what we’ve long maintained: that even now, under the guise of ‘reform,’ bishops continue to deceive parishioners and the public about their ongoing efforts to hide abuse.”

    Adamec, the retired bishop, did not respond to a request for comment.

    A prominent Danish mosque has told their congregation that apostates, adulterers and any one who harms a Muslim should be killed. The Mosque chairman defended the sermons, saying, “we believe in Islam”.


    The Grimhøj Mosque in Aarhus made headlines last month, when one of their imams defend child rape among recent migrants because it is part of their culture. .

    The mosque also appeared to declare support for the Islamic State (IS) terror group in 2014, and again in 2015. However, local police later praised the mosque, claiming they were in fact discouraging young Muslims from joining the Jihad.

    Now, a new documentary by Danish broadcaster TV2 has reignited debate over whether the infamous mosque should be shut down. Radical preacher Abu Bilal Ismail (pictured above) was secretly filmed saying:

    “If a married or divorced women engages in fornication, and she is not a virgin, she should be stoned to death”.

    Continuing: “If someone violates their marriage, either man or woman, they commit adultery and their blood is thus halal [acceptable under Muslim law, ed.] and they should be killed by stoning. If the woman is a virgin, the punishment is whipping”.

    In the clip, the imam advocates an “eye for an eye” policy. “If someone kills a Muslim, then they should be killed,” he says, before adding that anyone who leaves Islam (Apostasy) should also be murdered.

    “It is completely unheard of that there are people in Denmark preaching this sort of thing. It clearly does not belong here. He [Abu Bilal Ismail, ed.] doesn’t belong in Denmark either,” Integration Minister Inger Støjberg told the Ritzau news agency.

    Marcus Knuth, from the ruling Venstre party, said that it is hard to believe that the same mosque can be the centre of repeated controversies.

    “What is so shocking is that there are so many cases involving this mosque and that they just keep coming. That is almost the worst thing – that they haven’t learned anything and still practise these types of things and encourage this Stone Age behaviour,” he told TV2.

    The mosques’s chairman, Oussama El-Saadi, who personal declared his support for IS last year, defended the comments and said the TV2 journalist was a “spy” who had tricked the Imam responsible.

    “Our imam needs to answer what he has read on Sharia, when TV2’s spy asks him about Sharia. We can’t cheat and say incorrect things about our religion”, Mr. El-Saadi said.

    Adding: “We believe in Islam as it is, but as our imam says we live in Denmark, where there is freedom, and we followed Danish rules and Danish laws. So stoning and whipping aren’t valid in Denmark”.

    Breitbart London reported on Mr. El-Saadi last month when he spoke out in favour of child brides in Denmark. Speaking to a Danish newspaper, the Imam said: “One should look at these cases from a different perspective.

    “It is an extraordinary humanitarian situation, and I think you have to take care of these families. They’re married, and even if the man is twice as old as they have built a family. We have to accept that it is a different culture, and we can not destroy family life”.

    East Jutland Police said on Twitter that they would “investigate the remarks further and determine if it is a punishable situation”.

    La justice enquête sur des accusations de "non-dénonciation de crime" émanant de victimes d'un prêtre, poursuivi pour des agressions sexuelles il y a plus de 25 ans, et qui mettent en cause des responsables du diocèse de Lyon dont le cardinal Barbarin.

    Cette enquête préliminaire ouverte par le parquet de Lyon porte aussi sur des faits de "mise en danger de la vie d'autrui" en marge de l'affaire de ce religieux, mis en examen fin janvier pour des agressions sexuelles sur de jeunes scouts lyonnais entre 1986 et 1991.

    Elle a été ouverte à la suite d'un signalement de victimes, mettant en cause plusieurs responsables du diocèse dont le cardinal Philippe Barbarin, qu'elles accusent de ne pas avoir dénoncé à la justice les agissements passés de ce prêtre.

    Une des victimes a confirmé à l'AFP avoir déposé une série de plaintes visant le Primat des Gaules, deux personnalités diocésaines mais aussi le cardinal Müller, préfet de la Congrégation pour la doctrine de la foi que Mgr Barbarin a consulté au sujet du père Bernard Preynat, ainsi que son secrétaire.

    Si l'enquête du parquet ne vise expressément aucune de ces personnalités, elle constitue cependant un nouveau coup dur pour l?Église lyonnaise qui doit affronter une tempête médiatique depuis la révélation de cette ancienne affaire de pédophilie.

    - 'Sérénité et confiance' -

    Le cardinal Barbarin a pris acte "avec gravité" de l'ouverture de cette enquête, assurant que lui-même et le diocèse coopéreraient "avec sérénité et confiance avec la justice" en fournissant aux enquêteurs "toutes les informations à leur disposition pour faire la lumière sur ces événements, dont la complexité et l?ancienneté exigent une approche prudente".

    Un communiqué du diocèse affirme que dans cette affaire, le cardinal Barbarin "a agi avec "extrême responsabilité", comme l?a rappelé le 19 février 2016 le porte-parole du Vatican". "Le cardinal Barbarin tient à rappeler qu?il n?était pas archevêque de Lyon à l?époque des faits (Mgr Albert Decourtray l'a été de 1981 à 1994, ndlr) et qu?il n?a jamais couvert aucun fait de pédophilie", ajoute le texte.

    "Le dossier se poursuit. C'est plutôt positif. Ce sont ces questions que nous voulions poser", a déclaré de son côté à l'AFP une des victimes, François Devaux. "Il y a des personnes qui ont su et qui n'ont rien fait. Est-ce acceptable ? Les gens doivent savoir que c'est un délit."

    Soupçonné d'agressions sexuelles sur de jeunes scouts il y a plus de 25 ans, le prêtre Preynat qui a quitté ses paroisses du Roannais fin août 2015, suspendu par le diocèse après avis du Vatican, a reconnu les faits devant les policiers. Il a également été placé sous le statut de témoin assisté pour des viols qu'il a avoués en garde à vue.

    - Un évêque condamné en 2001 -

    Selon son avocat, Me Frédéric Doyez, le septuagénaire a déclaré devant le juge "que les faits étaient connus par les autorités ecclésiastiques depuis 1991", date à laquelle il avait été écarté du groupe scout indépendant qu'il encadrait depuis près de 20 ans à Sainte-Foy-lès-Lyon, une banlieue cossue de Lyon.

    Aucun nouveau fait délictueux postérieur à 1991 visant le père Preynat n'a été signalé.

    Mais pour une association de victimes, "La Parole libérée", c'est "l'omerta" dont aurait bénéficié le religieux durant des décennies, et la gestion du cas de ce prêtre par les autorités diocésaines depuis 25 ans, qui constituent le véritable scandale de ce dossier.

    Volonté de transparence ou maladresse ? Après avoir révélé l'affaire en octobre, le cardinal Barbarin a déclaré, dans un entretien accordé à La Croix le 11 février, avoir été mis au courant de "comportements" de ce prêtre "vers 2007-2008".

    Un mois plus tôt, le diocèse de Lyon avait indiqué que le cardinal Barbarin avait "reçu les premiers témoignages au sujet de ce prêtre à l?été 2014". Il a précisé depuis que ce "témoignage direct" venait d'une victime, ce qui n'était pas le cas en 2007-2008, et concernait "des faits prescrits".

    Si le Vatican a apporté son soutien au cardinal, estimant qu'il gérait le dossier "avec beaucoup de responsabilité", confronté "à une situation qui remontait à des années auparavant", l'affaire reste embarrassante pour l'épiscopat français, qui a mené un grand travail sur la prévention de la pédophilie depuis la condamnation de l'évêque Pierre Pican, en 2001, pour non-dénonciation de viols sur mineurs commis par un prêtre.

    Il y fait le point sur les dépositions du cardinal George Pell devant la Commission royale d’enquête et sur l’Oscar obtenu par le film Spotlight., rappelant les mesures prises sous Benoît XVI et sous le pape François contre la pédophilie.

    Les dépositions du cardinal Pell devant la Commission royale d’enquête, transmises en direct entre l’Australie et Rome, et la remise contemporaine de l’Oscar du meilleur film à Spotlight, pour le rôle joué par le Boston Globe pour dénoncer les couvertures des crimes de nombreux prêtres pédophiles à Boston (surtout dans les années 1960-1980), ont été accompagnées par une nouvelle vague d’attention des médias et de l’opinion publique sur la question dramatique des abus sexuels sur des mineurs, en particulier de la part de membres du clergé.

    Mémoire de l’action de l’Eglise

    La présentation sensationnelle de ces deux événements a fait que, pour une grande partie du public – surtout s’il est moins informé ou s’il a la mémoire courte – on pense que dans l’Église rien n’a été fait ou très peu pour répondre à ces horribles drames et qu’il faut donc recommencer à partir du début. Une observation objective montre qu’il n’en est pas ainsi.

    Le précédent archevêque de Boston a renoncé en 2002, à la suite des événements dont parle précisément Spotlight (et après la fameuse réunion des cardinaux américains convoquée à Rome par le pape Jean-Paul II, en avril 2002). À partir de 2003 (c’est-à-dire depuis 13 ans), l’archidiocèse est gouverné par le cardinal Sean O’Malley, universellement connu pour la rigueur et la sagesse avec lesquelles il affronte les questions des abus sexuels, au point d’avoir été nommé par le pape parmi ses conseillers et Président de la Commission qu’il a constituée pour la protection des mineurs.

    Les tragiques événements des abus sexuels en Australie font l’objet d’enquêtes et de procédures légales et canoniques depuis de nombreuses années. Quand le pape Benoît XVI se trouvait à Sydney pour la Journée mondiale de la jeunesse en 2008 (c’est-à-dire il y a 8 ans), il a rencontré un petit groupe de victimes au siège même de l’archidiocèse gouverné par le cardinal Pell, étant donné que cette histoire était déjà alors d’une grande actualité, et l’archevêque considérait que cette rencontre était très opportune.

    Dossier en ligne

    Ne serait-ce que la section du site en ligne du Vatican consacrée aux « Abus sur des mineurs. La réponse de l’Église » donne une idée de l’attention avec laquelle ces problèmes ont été suivis ; elle a été créée il y a environ 10 ans et elle contient plus de 60 documents et interventions.

    L’engagement avec lequel les papes ont courageusement fait face aux crises qui se sont manifestées successivement dans différents pays et situations – comme les États-Unis, l’Irlande, l’Allemagne, la Belgique et la Hollande, les Légionnaires du Christ… – n’a été ni mince ni indifférent. Les procédures et les normes canoniques universelles renouvelées ; les lignes directrices demandées et formulées par les Conférences épiscopales, non seulement pour répondre aux abus commis, mais aussi pour les prévenir de façon adéquate ; les visites apostoliques pour intervenir dans les situations les plus graves ; la profonde réforme de la Congrégation des Légionnaires, ont toutes été des actions destinées à répondre en profondeur et avec clairvoyance à une plaie qui s’était révélée d’une gravité surprenante et dévastatrice, surtout dans certaines régions et à certaines époques.

    Benoît XVI aux catholiques d’Irlande

    La Lettre de Benoît XVI aux fidèles irlandais en mars 2010 demeure probablement le document de référence le plus éloquent, bien au-delà de la seule Irlande, pour comprendre l’attitude et la réponse juridique, pastorale et spirituelle des papes à ces drames de l’Église de notre temps : reconnaissance des graves erreurs commises et demande de pardon, attention prioritaire et justice pour les victimes, conversion et purification, engagement à la prévention et formation humaine et spirituelle renouvelée. Les rencontres des papes Benoît et François avec des groupes de victimes ont accompagné ce désormais long chemin par l’exemple de l’écoute, de la demande de pardon, de la consolation et de l’implication personnelle des papes.

    Dans de nombreux pays, les résultats de cet engagement de renouvellement sont réconfortants, les cas d’abus sont devenus très rares et par conséquent la majeure partie de ceux dont il s’agit aujourd’hui et qui continuent à venir à la lumière appartiennent à un passé relativement loin de plusieurs décennies. Dans d’autres pays, en général en raison de situations culturelles très différentes et encore caractérisées par le silence, il y a encore beaucoup à faire et les résistances et les difficultés ne manquent pas, mais la route à parcourir est devenue plus claire.

    Commission instituée par le pape François

    La constitution de la Commission pour la protection des mineurs, annoncée par le pape François en décembre 2013, constituée par des membres de tous les continents, indique la maturation du chemin de l’Église catholique. Après que l’Église a défini et développé en interne une réponse déterminée aux problèmes d’abus sexuel sur des mineurs (par des prêtres ou par d’autres membres de l’Église), le problème se pose systématiquement de savoir non seulement comment bien répondre au problème partout dans l’Église, mais aussi comment aider plus largement les sociétés dans lesquelles l’Église vit, à faire face aux problèmes d’abus et de violations commis contre des mineurs, étant donné que – comme tout le monde doit le savoir, même s’il existe encore une réticence considérable à l’admettre – partout dans le monde, la très grande majorité des cas d’abus ne se produit pas dans les milieux ecclésiaux mais en dehors de ceux-ci (en Asie, on peut parler de dizaines et dizaines de millions de mineurs abusés, certainement pas dans un environnement catholique…). En somme, l’Église, blessée et humiliée par la plaie des abus, entend réagir non seulement pour son propre assainissement, mais aussi pour mettre à disposition sa dure expérience dans ce domaine afin d’enrichir le service éducatif et pastoral qu’elle rend à la société tout entière : celle-ci a généralement encore un long chemin à faire pour se rendre compte de la gravité des problèmes et pour les affronter. Dans cette perspective, les événements romains de ces derniers jours peuvent finalement être lus dans une perspective positive.

    Le dialogue du card. Pell

    Il faut prendre acte du témoignage personnel digne et cohérent (une vingtaine d’heures de dialogue avec la Commission royale !) du cardinal Pell, d’où ressort une fois encore un cadre objectif et lucide des erreurs commises dans de nombreux environnements ecclésiaux (dans ce cas-ci, en Australie), au cours des dernières décennies. Et ceci est un acquis qui n’est pas inutile dans la perspective d’une commune « purification de la mémoire ». Il faut aussi reconnaître la disponibilité exprimée par divers membres du groupe des victimes venu d’Australie pour établir un dialogue constructif avec le cardinal Pell et avec le représentant de la Commission pour la protection des mineurs, le p. Hans Zollner S.I. de l’Université pontificale grégorienne, avec lesquels ils ont approfondi des perspectives d’engagement efficace pour la prévention des abus.

    Si donc les appels, qui ont fait suite à Spotlight et à la mobilisation de victimes et d’organisations à l’occasion des dépositions du card. Pell, contribuent à soutenir et à intensifier la longue marche de la lutte contre les abus sur des mineurs dans l’Église catholique universelle et dans le monde d’aujourd’hui (où la dimension de ces drames est sans bornes), qu’ils soient les bienvenus !

    Cette pensée est vraie. Dieu n'a jamais demandé que l'on se marie devant un homme d'église ou devant la mairie. Le mariage entre un homme et une femme se fait sur la base de l'amour et de leur consécration à vouloir grandir ensemble dans la foi de Dieu, en mettant en pratiques les lois divines sur le mariage. Mais où il y a dérive, dans ce projet, est que contrairement à ce que je viens de vous expliquer, ce changement pourrait amener les mariages forcées, les mariages avec les enfants, ce qui va complètement avec les lois de la Sharia qui sont, je vous le répète encore, viennent du Vatican qui devant le peuple joue hypocritement le rôle de défenseur de la foi avec son Conseil Pontifical sur la famille. Elle le fait tout autant, en ce qui concerne le programme LGBT(I). Ce changement amènera la servitude et l'exploitation de la femme avec toutes les conséquences s'y reliant. Nous voyons que l'on est en train de renverser les lois divines sur le mariage établie par le Créateur, en lui donnant une nouvelle définition.

    Une porte ouverte vers un « régime religieux parallèle » ; une menace à l’égalité hommes-femmes ; un risque de « normalisation des mariages forcés » ; l’opposition a pressé mardi la ministre de la Justice du Québec à faire marche arrière dans le dossier des mariages religieux et de leurs conséquences civiles.
     
    « Au Québec, un mariage comporte des droits et obligations, peu importe la religion », a soutenu le député caquiste Simon Jolin-Barrette. Le porte-parole en matière de justice trouve « absolument déconcertante et irresponsable » la position défendue par la procureure générale dans un procès où un homme soutenait que sa liberté de religion était brimée par deux articles du Code civil liés au mariage.
     
    Dans son jugement, la juge Christiane Alary, de la Cour supérieure, a retenu l’argument de Québec voulant que les « ministres du culte puissent célébrer des mariages à portée uniquement religieuse ». Cette interprétation a fait sursauter plusieurs juristes depuis que Le Devoir en a parlé lundi. « On n’a jamais interprété le droit comme ça au Québec », a résumé Alain Roy, président du Comité consultatif sur le droit de la famille.
     
    « Le gouvernement Couillard ne s’en rend probablement pas compte, mais il ouvre toute grande la porte à la normalisation des mariages forcés, pense Simon Jolin-Barrette. Avec une telle position, les libéraux s’attaquent à l’égalité entre les hommes et les femmes. »
     
    Selon lui, « si rien n’est fait, c’est comme si la société acceptait qu’un homme puisse marier une femme devant un imam, un prêtre ou un rabbin en toute clandestinité, l’abandonner avec ses enfants au bout de quelques années et la laisser se dépêtrer sans aucune obligation. La ministre doit envoyer un signal clair : de tels mariages n’ont pas lieu d’être au Québec. »
     
    Le député estime plus globalement que « la liberté de religion ne doit pas être utilisée pour justifier une dérogation aux règles de droit applicables à tout le monde ».
     
    Le Parti québécois a des craintes semblables. « L’inquiétude, si on a un mariage sans effet civil, c’est d’en venir à l’instauration d’un régime religieux parallèle », estime la députée Véronique Hivon. Dès lors qu’une cérémonie se déroule en dehors des règles du Code civil, cela voudrait notamment dire que le consentement des deux parties n’a pas à être vérifié selon les normes, fait-elle valoir.
     
    Or, l’un des mécanismes reconnus pour lutter contre les mariages forcés est précisément le rempart du consentement libre et éclairé, indiquent Mme Hivon et M. Jolin-Barrette. C’est d’ailleurs le modèle retenu par le projet de loi59 pour réduire les risques de mariages forcés.
     
    Mme Hivon se demande notamment « comment on viendrait vérifier s’il n’y a pas multiplication d’unions et de mariages forcés dans ce système parallèle ? ».
     
    Nonchalance
     
    Députée de Québec solidaire, Manon Massé dénonce pour sa part la « nonchalance » de la ministre de la Justice dans ce dossier. « Créer un nouveau type de mariage — sans conséquence civile —, ça nécessite une réflexion beaucoup plus large », estime-t-elle.
     
    Tant les solidaires que le PQ et la CAQ estiment que le dossier actuel illustre que « le dépoussiérage du code de la famille est urgent », et que Québec doit annoncer au plus tôt quel type de consultation il mettra sur pied pour donner suite au rapport du Comité consultatif sur le droit de la famille.
